- DocForms shall not be liable for any loss or damage arising from your failure to safeguard account credentials.
5. User-Uploaded Content
- Ownership: You retain ownership of all documents and content you upload.
- Limited License: You grant DocForms a non-exclusive, royalty-free, worldwide license to process, host, and display your content solely to operate and improve our services.
- Responsibility: You are solely responsible for the content you upload, including its legality, accuracy, and compliance with applicable laws (e.g., HIPAA).
- Third-Party Data: If you upload data containing third-party information, you warrant that you have obtained all required consents.
6. Data Storage and Security
- DocForms utilizes Google Cloud Platform (GCP) for hosting and storage.
- We apply reasonable administrative, technical, and physical safeguards to protect your data.
- However, no system is entirely secure. You acknowledge that transmission and storage of data carry inherent risks, and DocForms cannot guarantee absolute security.
- You are encouraged to maintain backup copies of all important documents.
7. Third-Party Services
DocForms may rely on third-party tools, APIs, and hosting providers. We are not responsible for the acts, omissions, or policies of these third parties.
8. Prohibited Use
You agree not to:
- Upload malicious code, viruses, or unlawful material.
- Violate any local, state, or federal law.
- Attempt to gain unauthorized access to our systems or data.
- Use the platform for activities that harm others or DocForms' reputation.
9. Service Availability
DocForms strives for continuous service but does not guarantee uninterrupted or error-free operation. Maintenance, updates, or outages may temporarily affect access.
10. Disclaimer of Warranties
The services are provided "as is" and "as available" without any warranties, express or implied. DocForms disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law:
- DocForms shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data or profits.
- DocForms' total aggregate liability shall not exceed the total fees (if any) paid by you during the 12 months preceding the event giving rise to the claim.
- DocForms is not liable for data breaches, losses, or unauthorized access except where directly caused by DocForms' gross negligence or willful misconduct.
12. Indemnification
You agree to indemnify and hold harmless DocForms, its directors, employees, and affiliates from any claims, damages, or liabilities arising from:
- Your use or misuse of the platform.
- Violation of these Terms.
- Violation of any law or third-party rights.
13. Termination
DocForms reserves the right to suspend or terminate your account without notice if you violate these Terms or engage in conduct that may harm the platform, other users, or our reputation.
14. Modifications to Terms

15. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict-of-law principles.
- Any disputes shall be resolved exclusively in the state or federal courts located in Cobb County, Georgia.
